Who is responsible for the swimming pool filter when renting a home?

We moved into our rental home in December 2008. Our home has an in-ground swimming pool. We had the pool professionally opened on May 7th. The pool company said the filter is broken and needs to be replaced. The cost of replacing the filter and having it installed is 00. I contacted the home owner and she said they don't have the money to replace the filter at this time. Who is responsible for replacing the swimming pool filter?
I also wanted to know if it would be OK to deduct 00 from next months rent to pay for the filter?

    Pool maintenance usually falls on the tenant. You are going to need to read your lease to figure out who pays for this. Most likely it is you, but your lease may state otherwise.

    the pool is part of the rental property… it is included as part of the "package" the rental property was listed as having an inground pool and as you rent, the landlord is responsible for repairs to this pool as long as the TENANT (you) did NOTHING to damage the landlords property…so in this case, the landlord is OBLIGATED to have a new filter installed or she or he was obligated to explain at the time of the lease signing that the pool filter was defective… she HAD to have known before she rented the house and pool to YOU… tell her since the pool is unuseable and the pool was part of the rental "package" you plan on deducting the costs of you taking your family to a beach or public pool until or you can tell her you will deduct a certain amount from your rent until the pool is fixed… she will have someone over almost immediately to fix the pool….if you’ve been excellent tenants so far, she will not want to lose you and the pool could be a lease breaker in YOUR FAVOR

    Little and Landlord gave good answers but allow me to add my opinion. First off–your Landlord goofed by not adding specifics to the lease regarding the pool-absent that- I agree that you are responsible for cleaning -chemicals-maintaince-and insurance to cover your guests.But as far as a major repair like this–I cant see you bearing the entire expense. I also agree that the property is worth less to you with the pool unusable. If you deduct the $1300 -your landlords may not be able to meet their expenses and it will certainly create hard feelings. i have worked on pools and never heard of a filter that cost that much, Even if your pump is shot that sounds like too much and a second opinion is in order.. Try to work it out with the owner–perhaps sharing the expense–deducting a little each month–or footing the bill and having the repair amount added to your security depoist for return when you move. Moneys tight for everyone–so be creative and im sure something can be worked out.
